American Family Radio host Abraham Hamilton speaks from South Carolina about homeschooling
Welcome to the Hamilton Corner here on American Family Radio. I'm your host, Abraham Hamilton iii, broadcasting live from beautiful Greenville South Carolina, downtown Greenville South Carolina to be specific, where I am attending the BJU Press Homeschool Foundation Summit. And it has been, man, what a amazing, inspirational, informative and educational and challenging time we've been having here. We'll broadcast live here today and tomorrow we'll have a couple other episodes coming from here as well to round out the week. but we've been on the road, we've been on the road quite a bit lately and this will continue really throughout this year. but thank you so much for tuning into the program. So much is happening around the country, so much is happening in the world. But this is the place where we remind you every day that what goes on in your house is far more important than what goes on in the White House. And simply put, you know by now if you've been listening to the show, if you're new to the program, the simple purpose for articulating that recalibration in that manner is to enable us to simply do that, to recognize that what we do to generate revenue is a, ah, vital, instrumental, indispensable component of our lifestyles. But they are not synonymous with our identities. And in fact the full time job for the believer is actually outcome cultivation. It's just been fortified and reaffirmed in me. you know, you guys know, last week we were in Nashville, Tennessee, then we went down to North Louisiana, the Simsborough First Baptist Church. What an amazing time we had there with Pastor Jason and Brother Hank and the Simsborough family. and now we're in South Carolina. It's kind of a whiplash bit of travel but it just affirms and confirms for me once again the reality that disciple making is the order of the day. We must, we must be about our Father's business. The Great Commission is not Go ye therefore and make converts. Proclaiming the gospel, Seeing men and women born again through the regenerative work of the Spirit of God. Is an indispensable component. But the Great Commission goes beyond conversion to making disciples. And if we do not make disciples, and I, continue to present this analogy, we live in the United States of America, where every American citizen is guaranteed by our constitution, the Article 4 right to a constitutional republican form of government with democratic features, where the citizenry participates in electing our servant leaders. If and when we have a continuously wicked populace, how long do you expect that populace to endure righteous leadership? Much of the societal hemorrhaging that we're experiencing in our country, we are experiencing it because men love darkness rather than light. We have allowed a combination of often, our history, the phenomena I describe as churchianity, our material abundance, and a host of other factors to kind of converge to create a comfortable deception. Jesus's example with the fig tree should be instructive for us. From a distance, the tree appeared to have fruit on it. It appeared to be a fruit bearing tree. The expectation was that there was fruit on that tree. But upon closer examination, when Jesus examined the tree up close and personal, he found that the tree was fruitless for too long in our country. And really, and I've talked about this before, we're really dealing with the, the harvest from seed sown, a century or more ago to move our nation into a comfortable godlessness. There's never been a time in our nation's history where we've been perfect. But there was a time when we had a far more biblically literate society. There was a time when, the truths in scripture were embraced in much more robust fashion than there are now and in our nation's history. When we got, when our nation was at our worst, it was because we had rejected the truths that are contained in scripture. And we are at a similar precipice, a similar juncture in our nation's history today. And the disciple making function is something that, that only the Lord's bride can do. Something only the Lord's bride can do. We must be about our Father's business. So as many of you right now are making your transition from your part time jobs where you generate an income to your full time jobs where you cultivate an outcome, please embrace the encouragement to do so with intentionality. Understanding the primacy that God places on family, recognizing that the familial unit is central to God's plan to establish his kingdom generationally is central to God's plan. There is no replacement or substitute for the family. And if God could get ahold of us within our own families, man. And if Christian parents would take the lead in discipling our children as God has commanded us, there's no question as to what we could see transpire in our nation. To the word of God we go.
Isaiah chapter one is where we begin the program today
Isaiah chapter one is where we're going to begin the program today. Isaiah Chapter one. And yes, on site with me once again is the producer extraordinaire, the real J. Mac. The contingent is on tap, Mr. M. Bobby Rosa, my man, 100 grand is on the board. Mr. Marty Sparks is aiding us in delivering the video content to you this evening. And we're ready to rock and roll with today's edition of the show. Isaiah, chapter one. Isaiah, chapter one. Isaiah ministered from about 767 to about 681 BC, about a century, a little over a century prior to the Babylonian exile being the culmination of the Babylonian conquest and exile of Judah. And the Lord attempted to warn Israel and warn Judah through his prophets. And at this juncture, the prophet Isaiah is confronting Judah concerning her sinfulness. And Isaiah chapter 1, verse 4 reads thusly, Alas, sinful nation, people weighed down with iniquity. Offspring of evildoers, sons who act corruptly, they have abandoned the Lord. They have despised the Holy One of Israel. They have turned away from him. Where will you be stricken again as you continue in your rebellion? The whole head is sick and the whole heart is faint. From the sole of the foot even to the head. There is nothing sound in it, only bruises, welts and raw wounds, not pressed out or bandaged, nor softened with oil. Your land is desolate. Your cities are burned with fire, your fields, strangers or foreigners are devouring them in your presence. It is desolation as overthrown by strangers. Right in verse four. When you see, and if you're watching this show, you see it on the screen. When Isaiah exclaims, alas. It's a cry of pain, guys. It's a cry of pain. And I ask myself, Do the believers in our nation currently. And again, I'll say this, I shouldn't have to disclaim this. People should understand this. I know America, the United States of America, is not Israel. I understand that. But there are things in Scripture that we should, that we can navigate and we can see. And when we measure our own nation by the truths of Scripture, we will see some things with a bit more clarity. Isaiah's cry of alas. Concerning the sinfulness of the nation of Judah was a cry of pain. It was even personal to him. I truly wonder, you know, whether the believer in our nation is grieved by the state of sinfulness in our country. I mean genuinely grieved. Not just bothered by it. Not just want to kind of dunk on the. Dunk on the lips, drink lip tears. You know, you're so confused. You don't know a man from a woman. Oh, look at this dunce. You know, not that kind of stuff. But. Ah, but but a holy spirit induced grief concerning that. That when we see these people and. And these folks who will experience the carnage as a result of rejecting the truth of scripture, do we have a cry of pain similar to that not merely for how it affects us or it affects the quality of our lives, but for the state of the soul of the unbeliever? It's a question that I often have. The last sinful nation. People weighed down with iniquity. A synonym for being weighed down with iniquity is sin ladened. And this sin laden condition that has overrun Judah at this stage. I mean, remember, this is a nation whose name means praise. But here they're identified as sin laden. The latter part of verse 4. The Prophet Isaiah describes that as despising the holy one of Israel, Despising God, Despising him. Isaiah identifies. They have abandoned the Lord. They have despised the holy one of Israel. They have turned away from him. Where will you be stricken again as you continue in your rebellion? Isaiah? Is Isaiah saying, how many warning judgments can you endure? It's almost like to. To kind of make it plain, you know, some of y' all might have grew up similar to where I grew up. In the Hamilton household where Mr. Hamilton Jr. And Mrs. Hamilton presided. There was no question as to whether or not corporate punishment, corporal punishment would be employed. And you ever had one of those, One of those weapons? Not a weapon, not too light spanking? No whooping. Ever had a whooping when you ain't have no more territory that had been untouched? Yeah, some of y' all know what I'm talking about. You ever had, man? Every. Every part of the. Every part of the surface area has been touched. That's what Isaiah is saying as inspired by the Lord. Where will you be stricken again? How else can you be judged in order for your attention to be. To be captured? How else can. Can the lord catch your attention as you continue on your rebellion? The whole head is sick. The whole heart is faint from the sole of the foot even to the head. Here you have the anthropomorphization of the. Of the nation to where Isaiah is using a description for that people will understand, you know, and at this time, someone would sick and say, the whole head is sick. that's a comprehensive entire. There's. There's a sickness in the entirety, is what Isaiah is saying. From the foot even to the head, there's nothing sound in the body, only bruises, welts, and raw wounds. Not just wounds, but wounds that are raw, untreated, unbandaged. Then you get down to verse seven, and you got to remember this is a, people who has Deuteronomy, chapter 28, you know, if you hearken diligently to the voice of the Lord your God, to do all that he commands you, all of these blessings will befall you.
Walker Wildman: AFA Action is fighting for American family values
However, that's verses one through 14. But verse 15, verse 15 hits you with the but. However, if you do not hearken, this shall be your expectation. Then you get 28 verses of the calamity that would befall the rebellious nation. And Isaiah said, you, cities are burned with fire. Didn't we just come through a summer where the city was on fire? Your field strangers are devouring them in your presence. Desolation as overthrown by strangers. I'm asking the believer, have we considered when you have, for example, the massive lawlessness through illegal immigration that has befallen our nation under the previous administration, have we considered the spiritual implications of that? The fallout of Minnesota recently concerning ice, the ICE operations all around the country. I think we have to get beyond merely assessing things concerning, as it pertains to the political realities, and we have to examine them in light of scripture. the most desperate, enduring need in our nation is repentance. Man and the body of Christ has to lead in communicating God's heart on this matter.
>> Walker Wildmon: They're coming for your family. Not with guns, not with armies, but with laws, with lawsuits, with ballots and bureaucrats. Parental rights are under attack. Marriage is being redefined. Your values, they want them silenced. And they're counting on YouTube to do nothing. But here's the thing. We're not backing down. I'm Walker Wildmon, and AFA Action is in the fight, in the legislature, in the courtroom, and at the ballot box. We're stopping bad legislation. We're challenging activist judges, and through I voterguide, we're helping Christians vote like it matters, because it does. Thousands of families are already standing with us, and I believe the American family is still worth fighting for. But we can't do it without you. And we need your help today. Visit afaaction.net right now. Give today join us on the front lines because the Other side isn't slowing down, and neither can we. Afaaction.net, your voice, your values, your vote.

Mexican National Guard killed cartel leader in shootout with Mexican military
All right. By now, I'm sure almost all of you have heard about the absolute insanity that broke out over the weekend, in Mexico just south of our border. It should not be lost on us that this happened just after. Oh, yeah, we had to shoot down some drones in El Paso, Texas, that cartel members had just floated over into American airspace. as you probably have heard reported now, and I'll give some additional details. I don't know if you've heard all of these details that I'm going to share now, but the head of the notorious Jalisco NewSong Generation Cartel was murdered. The nickname he goes by or went by was El Mencho. And I'm saying murdered, not unjustifiedly. He was, he was taken out by the Mexican National Guard. Now, the Mexican Mexican National Guard was working in conjunction with U.S. intelligence. And for the longest, President Trump has said that. Look, I know Mexico has a president. We know about Claudia Sheinbaum. You know, it's always funny, how do you get a, ah, Mexican Marxist with the name Sheinbaum to be the president? It's pretty interesting. but the Mexican National Guard was working with the work, using US Intelligence to get El Mencho. but it led to a pretty significant shootout. There were over 25 Mexican National Guardsmen who were killed in this battle. More than 40 to 50, cartel members were killed. And some of the top, obviously most of the people are talking about El Mencho. And this is a cartel that was notoriously violent, notorious for outsized reprisals. And not only that, you had some of El Mincho's lieutenants that actually were killed in the process as well, but then you had some other lieutenants who weren't killed. They were shot, though, and they were able to scurry off into nearby woods. And the reports say that the cartel members flew away in aircraft from the Mexican National Guard. Before I get too far, I want you to listen to this clip that's describing the very thing that I'm talking about. It is clip number one. Clip one. Go.
>> Dr. Jessica Peck: Chaos erupts in parts of Mexico after one of the world's most wanted drug lords is killed. Nemesio Oseguera Cervantes, also known as El Mencho, died in a shootout with the Mexican military as they tried to capture him near Puerto Vallarta. New video posted online and verified by ABC News shows the military military operation against El Mencho. Gunshots or explosions and helicopters can be heard near a wooded area next to a cabin complex where the cartel leader was hiding out. Jalisco. New generation cartel members responded by blocking roads and setting vehicles on fire. President Claudia Chabaum says 25 National Guard members were killed in attacks in the state of Jalisco.
>> Abraham Hamilton III: Now, with all of that information, to President Trump's point, and one of the things that I don't think is getting enough attention, and this confirms President Trump's point that really the cartels have been running Mexico, that across 20 different states in Mexico, you had, and let me give the appropriate number, more than 250 roadblocks, all. Ah. In response to El Mencho's death, across 20 states, though, think about how expansive that is across 20 different states in the country. There's been lots of reporting about Costcos and American companies that have operations in Mexico being bombed. The Puerto Vallarta airport suffering some bombings, but bombings all across the entire nation. Soon as El Mencho is dead, then you have the Mexican military pursuing lieutenants. They're able to get to the woods, the forest nearby, but they have sufficient aircraft to board to just fly away from the Mexican military. Imagine something like that happening in the United States of America, right? Where you have like, some. Some drug lord, some drug dealer gets killed. And. And you have, you know, that's not how you say. Say you have 15 to 17 different states in our country that all of a sudden has these uprising and explosions and all this kind of stuff. And, and where I'm going with this, of course, this is another exercise of, United States of America's military prowess. Because could they have done this without US Intelligence? Well, let's. Let's just ask a couple questions. Has it been done before? Have the Mexicans been trying to. Been made to deal with elementary before? Certainly. It confirms the United States military is the most potent fighting for fighting force in the world. That's a fact. That's an unassailable fact. But the point I want to highlight, that's a little bit different than I think a lot of people have pointed out to you, because this is my opinion on this, this is a demonstration. When you see how absolutely out of control Mexico became immediately after El Mincho was taken out, all of these expressions of violent, reprisals by the cartel all over the country. Do you see why it was so important that we, as United States of America, keep up a, sound, firm grip on our southern border? You see, because my contention is that the whole world now has been confronted with just how much, or should I say how little control the Mexican government has over the cartels. Now, a lot of us have known that for a long time. A lot of us have known that, known this. A lot of us have known nothing goes down in Mexico without cartel consent. We've known. Been knowing this, but now the whole world has been confronted with this because, because El men. El Mincho is gone. And you can shut. You can shut, shut down the roads in 20 different states all at once, just like. Just like that, just like that. That you have the. The armament, the equipment and the ability that in the midst of a firefight with the military, y' all could retreat to aircraft and fly away. And we have people in our country, you know, that want to hem and haul and play tiddly winks about, ah, you just want to protect the boat because you racist and all this kind of stupidity where you're flirting with, with that kind of reality just out of our own country, just south of our own country. This should notice. I said should. I don't, I don't have high expectations for this to be what actually occurs, but this should put an end to any American flirtation with a poorest southern border. I m say should because the unfortunate reality is that regressives in our country are so committed to their ideology, so committed to their radical ideology, they have demonstrated their lack of concern for how many people are victimized as a result of their radical positions. Don't forget that in order for us to have the massive influx of illegal immigration via our southern border during Mr. M ice cream Man's administration, that him and his team had to literally go in and undo everything that President Trump did in the previous administration. You had to go to the fence, take the lock off and lift the latch and offer the policy version of y' all come now. And one of the things that is concerning to me in this regard. Is that this was done with no regard for what was happening in our own country. I'm grateful for the efforts that President Trump has employed since he's been back in the Oval Office, what Thom Holman is doing. I'm grateful, but I cannot help but think what all has gotten into our country. And then when you consider the great lynch people like Jacob Fry and Tim Walls and the Los Angeles mayor, I forgot her name at the moment. And all of these people that are trying to make it like it's the civil rights issue of our day, like, dude, if your desire is to get the criminal aliens out, why don't you let us go into the jails? Like, this is just dumb. This is just dumb. And you can play these ridiculous games if you want, but you're playing with fire. You're playing with fire in many ways. What's being demonstrated is that at a minimum, and I know this is kind of euphemistic sounding at a minimum, but the cartels have the money and the weaponry and the equipment to rival the Mexican government. Others would say quite plainly we outgunned the Mexican government. That's why nothing goes down without cartel, permission. And now you have complete m. Complete chaos.
Hamilton Corner: Democrats will offer Spanish-language response to State of Union speech
Would the regressives in our country mind too much if we fortified our southern borders even more now? Would that be Too much to ask. Would that be too much to have a conversation about? Not to mention all of those who entered our country through the southern border who are not of Spanish heritage. Guys, this is just foolish. This is just so foolish to me, it's so foolish. And we continue to have these foolish notions that take root. And as I started out discussing in the first segment, that this is, this is beyond logic at this point. You, have people taking these positions that are beyond the capacity to reason with. Many of you have dealt with this like, man, Abe, I've explained this to them, I've talked logically with them. And they refuse to embrace this because a lot of what we're dealing with, guys, is spiritual. And now we have the State of the Union address tonight. President Trump is scheduled to speak and I'm sure he's going to talk about the terrorist decision. I'm going to discuss that because I read the 170 some odd pages of this opinion. What you have. Virginia's, newly elected governor Abigail Spamberger is going to do the Democrat response to President Trump's State of the Union speech, which it's just the audacity to do that is just remarkable to me. I know how they're going to spin it. They're going to say, whoa, yeah, because Abigail Spanberger was able to flip, a blue Virginia governor's mansion, I mean, a red Virginia governor's mansion blue. But I want you to look deeper. What they're literally saying is that, you know, it's almost like the Mandalorian. This is the way, you know, this is the way you can lie in your campaign, to present yourself as a moderate. And as soon as you get in office, will you let the commie colors fly or you pull Imam, Donnie. And I'm just like, man, save your op ed, save your, you know, CNN doing, running all these pieces. Blue states are out of control. Can you believe Zoran Mamdani wants to raise taxes in NewSong York City? And I'm just like, huh? Well, Jeff, color me surprised that you, you have a, self described Marxist that has already run out of other people's money and wants to raise more taxes to take more of other people's money. Ain't that a shocking move to you? I'm just like, these are the conversations and the pieces y' all should have been running before homeboy got elected. Oh, no, that's, because y' all didn't really have a problem with that. So you got them running Abigail Spanberger to say, hey, hey, hey, this, this, this is how you do it. You know, if you're in one of those hotly contested areas, hey, just make yourself look like you're a moderate and get elected and then you do all of the communist stuff that we're talking about. And then, then of course they're going to allow us Senator Alex Padilla of California, who replaced us trying to be president, the remix in the Senate to offer the Democrat response in Spanish, but the habla a little espanol. Mucho opoquito. We'll see more Hamilton Corner when we get back from this break.

U.S. women's hockey team declines State of Union invitation
>> Abraham Hamilton III: Welcome back to Hamilton Corner. Abraham Hamilton III here. You know what, what a tremendous time for our Nation celebrating not one but two gold medals in hockey. You know where the U.S. men's team out fellowshiped our labors to the north. You know, they, they, they tend to believe that they have a corner of the market on, you know, passing the puck. I know Bobby right now is cheesing from m ear to ear. If you don't know Bobby, look, look, he, that look, that's Bobby talking about the cowbell. This man is a hockey fan. Where the United States of America pulled out the tremendous victory, on the men's side and the women's side, both out fellowshipping the Canadians, in the gold medal gang, there will be members, from the men's hockey team, U.S. hockey team. They're already, in at the White House today. They made it to the White House today. They have pictures from the Oval Office, all kinds of things. They're expected to be at the State of the Union address this evening. But it just seems like this whole thing in our nation concerning younger women in our country not responding similarly to younger men in our country. The U.S. women's hockey team declined the invitation to attend the State of the Union address tonight. I'm not kidding. they had, a quite politically correct speech to offer, or should I say statement to issue, to respectfully decline the president's invitation. they said, we are sincerely grateful for the invitation extended to our gold medal winning U.S. women's hockey team and deeply appreciate the recognition of the extraordinary achievement. Due to the timing and previously scheduled academic and professional commitments following the games, the athletes are unable to participate. They were honored to be included and were grateful for the acknowledgement and the invitation. End quote. So while the men's hockey team and I just, you know, I don't, I don't know their schedules. I'm not gonna, you know, say anything or to impugn them. If they have schedule, they have schedules. But the men's game finished more recently. The men just won. The women won a few days ago. you know, and I, you know, the president offered to send a military plane to pick, them up to bring them from where they were to come to the State of the Union. Speaker Johnson is going to make sure they were accommodated with the room to attend the State of the Union address. The men's team is coming, but the women's team is not coming. And it's, it's sad to me for a host of reasons, because one, it just shows another example I've shared with you guys, the statistics concerning how younger men are skewing more conservative politically while younger women, I'll just say it this way to be kind, are not. They are not. and this is just another example of that. There was a time, and I think this is why you saw such a tremendous response all over our country. We are a, patriotic people, and when we think about sports, nobody wants to be confronted front and center with these people's political beliefs and all that kind of stuff. It was a time and a moment to celebrate as a nation and in fact, a unifying moment for our country, frankly, because they have some people. And I'm not even going to get into, you know, the leading goal scorer for the women's hockey team how, you know, she's accepting a proposal from a woman. Yeah. Oh, yeah, yeah. You should see just face. Yeah, yeah, yeah. Just before the gold medal game. You know, I'm not trying to even bring that up as a front and center consideration, but you. These. You don't see the value the women's hockey team. Now, let me finish my statement, then I'll say the next thing. You don't see the value in having this as a unified moment to celebrate the country, for the whole country to be able to rally around and celebrate that we, the United States of America, were victorious, especially in the circumstances where we were not expected to be. It just makes you sad. And you think about this. We are in the year where we are approaching the 250th anniversary of our Declaration of Independence. I don't know what their schedules are. Maybe they do have academic and professional, commitments that are inescapable. I could be wrong, but I do think any professor or anyone who had a professional obligation would say, hey, you need an extra day to go to celebrate and be celebrated for our nation. As we approach the 250th anniversary, I have a hard time believing they wouldn't have been able to find accommodation for such a commitment. Maybe I'm wrong. I could be wrong. I don't think that I am. But it's just a saddening thinking. It's a moment that we, we get deprived of as a nation. Instead of being able to, celebrate this together, they, have respectfully declined, and it's indicative of the times that we're in.
I agree with the decision that the court arrived at, but I disagree methodology
All right, go a little further. So in the tariffs case, Learning Resources Inc. I know this, this came out, a few days ago. Learning Resources Inc. Versus the President of the United States of America having to do with the tariffs. I want to say on the onset that I agree with the decision that the court arrived at, but I don't agree in their methodology. And more broadly. More broadly, I think it's weak sauce, man. The way that they arrived at the decision, you know, because you have several considerations. First, the issue was. The issue, plainly put, is whether or not President Trump has the unilateral authority to. And I want to get to this portion of the opinion. Let's see. There we go. No, that's not it. I want to. Yes, here. Here we go. I want to get the disportion of the opinion because the reality is it was kind of a weak sauce approach because you have a six justice majority and you have Justices Amy Coney Barrett and, Justice Gorsuch and Chief Justice John Roberts joining Justice Ketanji Brown Jackson, Justice Elena Kagan and Justice Sonia Sotomayor to make a sixth justice majority. And the issue, is the ieepa, the international, economic. let me get back up here to give you the full. Before I get to the acronym in the statute, the statute's full name. It is the International Emergency Economic Powers act, the ieepa, whether or not President Trump has the authority, the unilateral authority under the IEEPA to, impose tariffs. Right. And so what I'm saying is. Weak sauce. I had the page. There we go. So what you have at the six Justices, you have a kind of hodgepodge because you have Justices Sotomayor, Justice Kagan and Justice Jackson who say that the IEEPA does not authorize tariffs as a matter of ordinary statutory interpretation. But that is not the reasoning that Justice John Roberts, Chief Justice Roberts, Justice Gorsuch and Justice Barrett employed. What those Justices leaned on, and this is what Brett Kavanaugh, Justice Kavanaugh pointed out in his dissent, they leaned on the notion that, quote, the, major question canon of statutory interpretation was employed wrongly by the Trump administration. Basically that important canon requires, quote, clear congressional authorization for executive action of a major economic and political significance. Now, I understand what they're saying. I think that that breaks up the majority in my opinion. But in their view, it doesn't break up the majority because they all conclude the same way, even though they've concluded for different reasons. Now, I agree with the decision. I'm gonna explain why I agree with the decision because I have this radical thing, you know, this U.S. constitution. And my SCOTUS heroes are justice Thomas and Justice Alito. But I think their argument is flawed in this regard. Justice Thomas basically argued that Congress has the lawful authority to delegate its taxation power to the President. I kind of don't agree with that. I don't agree with that. And the core of Justice Thomas argument was that the non delegation doctrine says that Congress cannot delegate core legislative power to the President. When you zoom out and read the Founder's Constitution, and I would certainly not attempt, to say that I am more prudent, concerned the Constitution and Justice Thomas. But I disagree with him here. You know, he's a human being just like everybody else. Because I think his description of a core legislative power, a core legislative authority, is anything more core in the Founders vision of our Constitution than the ability to tax, you know. Now, Justice Kavanaugh, while he disagreed with the majority in the court in the case, he argued plainly that, well, while the majority finds the IEEPA as the inaccurate Constitution. I'm sorry, Congressional authority to base President Trump's tariffs on. He could have used other powers like the Trade act of 1974. There's another statute from 1962 that Congress granted authority. Now, I do, I do agree that Congress did that. But my contention here, and I think the court landed at the right conclusion for this reason. And I want to read this to you guys. And this is Article 1, Section 8, Clause 1 of the U.S. constitution. Article 1, Section 8, clause 1, And it says this, quote, the Congress shall have power to lay and collect taxes, duties, imposts and excises to pay the debts and provide for the common defense and general welfare of the United States, but all duties, imposts and excises shall be uniform throughout the United States. Now, the majority in the case said, well, yeah, the President has authority. He, he could shut down imports in total. that's, why I think this is such a, this is such an artificial, an artificial distinction. He could shut down imports in total, or he could allow imports, but he can't do the lesser. Think about this. This is literally what the six justices concluded. They said that President Trump, if he wanted to, if he wanted to stop China from importing anything to the US he could have done that, but he can't do the lesser thing and saying, well, if Chinese companies or the Chinese government wants to import goods or export things from China to be imported into the United States of America, the President cannot do the lesser thing and impose, a, duty for that, a tax for that. I just think that's weak sauce. If you can shut it down completely, why can't you charge them? I think the more appropriate constitutional balance, and this is why, and we have to consider these things until the full extent of their consideration. Because if the argument is the President either can shut it down in total, or if the argument is as Justice Kavanaugh asserted, which I don't agree with Kavanaugh's assertion either. Kavanaugh's assertion is that, well, the President can do so, he has to declare an emergency of his own initiative. Then he could tear whoever he wants. Just imagine for one moment you have a, ah, regressive Marxist, like, say, I don't know. Take your pick. She or shall never be president. The original, the remix, you know, Barack Hussein, you name them and you got to give them the authority to declare an emergency according to their own initiative and then to tariff whoever they wanted. I think you begin to see how that will fall apart. And here's the thing that I think that people fail to realize. Tariffs are taxes. Like, I want to give you this definition. I just read to you Article 1, Section 8, Clause 1. It referred to a duty specifically imposed in excises. The U.S. treasury Department's definition for a, duty is this. It's a tax levied by government on the import or export of goods. Impost act as a tax, especially an import duty. All right? There's a reason that the founding Fathers said taxation must occur and originate in the House of Representatives. When tariffs are applied, guys, foreign nations are not tariffed. The tariffs are applied to the companies in the United States of America that is importing the goods. So when you have Chinese companies, for example, selling things, the importer importers in America pay the tariff on it. And what usually happens is that the American companies pass off that tax onto the consumers. It's the goods that are tariffs, not the nations. I agree with the President's objectives. I agree that there's an, emergency concerning fentanyl. I agree that there was a problem with the massive trade deficits and imbalances. But you have to do what's necessary in a constitutional way.
We need to rebalance that. We need to restore domestic manufacturing, but we need to be faithful to Constitution
We need to rebalance that. We need to restore domestic manufacturing, but we need to be faithful to the Constitution. The Constitution needs to continue to guide our policy because President Trump is not going to be in office forever. We need to think through this thoroughly before we conclude.
