In a case that arose from litigation concerning congressional district drawings in North Carolina by its state legislature, the U.S. Supreme Court (SCOTUS) has now ruled in Moore v. Harper that state legislatures DO NOT have plenary authority concerning the time, manner and place federal elections are held, though that is exactly what Article 1, Section 4 of of the U.S. Constitution says.
SCOTUS’ extra-constitutional power conscription led Justices Thomas, Gorsuch, and Alito to dissent from the majority’s opinion, objecting to this unconstitutional abuse of power.
